These terms and conditions ("Terms") outline the expectations and agreements between Flying Upstream Podcast ("Podcast") and you, the Guest or Sponsor ("You").

Co-Creation with Clear Boundaries: We engage in the co-creation of content while maintaining final editorial control to ensure consistency with our format and core values.


Guest Conduct: Guests are expected to maintain professional and respectful behavior during recordings. Defamatory statements and non-compliance with legal standards of content creation are strictly prohibited.


Recording and Release: You agree to allow the Podcast to record, edit, reproduce, distribute, and display your interview or sponsored content in connection with the Podcast and its promotional materials.


Promotion: You are encouraged to promote your participation in the Podcast through your channels. We will provide promotional support as agreed mutually.


No Guarantee of Publication: Recording participation does not guarantee publication. The decision to publish is based on content suitability and quality standards.


Accessibility: Efforts are made to ensure podcast content is accessible to individuals with disabilities, including providing transcripts and captioned videos upon request


Feedback and Dispute Resolution: Procedures for handling feedback and resolving disputes involve steps such as third-party mediation, aimed at avoiding legal action.


Amendment Procedure: Terms and conditions may be amended with changes communicated to all parties in a timely manner.


Data Tracking and Cookies: As part of our efforts to enhance your experience with the Flying Upstream Podcast, we utilize various solutions that may involve the use of cookies and tracking technologies. These tools help us understand user behavior, improve our services, and provide a more personalized experience.

Content Ownership and Rights Transfer: All content created during the podcast remains the intellectual property of the creator unless otherwise agreed. The Podcast holds the right to use all content, including derivative works, for promotional or other purposes. Guests retain ownership of their contributions but grant a non-exclusive, worldwide, royalty-free license for their use in the podcast. By participating as a guest, you grant the Flying Upstream Podcast the permission to utilize content from your episode(s) in the creation of extended learning materials, including courses or worksheets, to further educate and engage our audience.


Episode Length and Scheduling: Podcast episodes are typically 25 to 30 minutes in length. Recordings are scheduled on weekdays to avoid weekend disruptions.


Revision Policy: Requests for edits post-recording will be considered and may be accommodated within a specified timeframe, subject to limitations on the extent of such edits.


Compliance with Laws: All parties must comply with applicable laws, including copyright, privacy, and communication decency standards. Any dispute, controversy, or claim arising out of or relating to this agreement, or the breach, termination, or validity thereof, shall be settled by arbitration administered by the American Arbitration Association (AAA), in accordance with its applicable rules and procedures governing such proceedings. The place of arbitration shall be Austin, Texas. The number of arbitrators shall be one, appointed in accordance with the said rules/procedures. The language of the arbitration shall be English. The decision of the arbitrator(s) shall be final and binding upon both parties.


Use of Likeness: Guests grant permission for their likeness and other branding materials to be used by the Podcast for promotional purposes without further compensation.


Sponsorship Disclosure: All sponsorships or paid endorsements are disclosed in accordance with FTC guidelines to maintain transparency with our audience.


Confidentiality: We commit to maintaining the confidentiality of any non-public information shared during the pre-production process, unless disclosure is authorized or legally required.


Right to Veto: We reserve the right to veto any content deemed inappropriate or incompatible with our values, with all decisions communicated promptly.


Cancellation Policy: Either party may cancel a scheduled recording under specified terms. Details on penalties or rescheduling options will be provided.


Termination: These Terms may be terminated by either party with written notice.


Acceptance: By participating in the Podcast, you agree to be bound by these Terms.

Cancellation and Refunds:

We understand that plans can change. To accommodate this, we offer a refund policy for our scheduled recording sessions. If you need to cancel your session, please note the following conditions:

Full Refund: You are eligible for a full refund if you cancel your session more than one business day before the scheduled recording date.

No Refunds: No refunds will be issued for cancellations made within one business day of the scheduled recording session.

This policy ensures that we can manage our scheduling and resources effectively while also respecting the time and commitment of our guests and staff. We appreciate your understanding and cooperation.
